"One of the reports quoted National Guardsmen on the scene as saying they are not allowed to "touch passengers".

I recall hearing that National Guardsmen can be deputized (or something to that effect) and that will give them policeman type authority. The rest are just window dressing and could be held personally accountable for their actions.

The NG, serving under State Active Duty has law enforcement powers. The "no touch" issue is a matter of "rules of engagement" - read: liability.
