This law is a total load. For one thing, with the possibility of a multi-million dollar payout, the trial lawyers will make sure this never goes away. Flipping through the Raleigh phonebook, I see several lawyers say they pursue alienation of affection. Therefore it is profitable for them for the law to stay. They are going to do everthing they can to make sure all lines to the bread and butter are going to remain open. Second of all, who ever promised you, me or anyone else a damn thing in this life, much less promise that anyone would be happy. Why should there be legal recourse for affairs of the heart. What if the unhappy spouse tried everything they could but to no avail couldn't find happiness with the person they married. People change, sometimes for the better and sometimes for the worse. I have talked to several people who said that their spouse chnaged the day they got married. So should there be legislation for marital fraud? Third, I guess some people are able to put a pricetag on feelings and emotions. Fortunately, I am not one of them.

Ah, but there's the rub. It is a legally binding covenant not only in the eyes of the state, but more importantly in the eyes of God Almighty. Last time I read the Bible(of which most marriages are done either in a synagogue or church, so therefore the people getting married are accepting their vows as binding in the eyes of both) it doesn't say "Well when you've grown apart and aren't happy, that's okay!!"

With all of this baggage that these two are causing in the lives of this wife and kids, then NOT JUST the cheating husband should be required to pay. The cheating mistress should also be held accountable for disrupting the lives of others.
Let me ask you this. If the spouse is a total F'n bitch, then why should the other spouse not be allowed to find his/her consolation elsewhere? Your claim that the one spouse cheats infers that he/she is a self-centered scumbag. The truth may in fact be that the other spouse is such a scum/bitch/bastard that it leaves them no choice. DO NOT say that the correct choice is divorce, because the same "poverty" that you seem to think is so heinous to befall one spouse, is the same poverty that a spouse wanting to leave a rotten partner will face if he/she pursues a legitimate end to the relationship.

Why should there be legal recourse for affairs of the heart.

Since the ease of divorce and lack of reprecussions for marital misconduct has become the norm in this country:
1. The divorce rate has sky-rocketed,
2. The number of one-parent families has sky-rocketed,
3. The amount of public aid to children has sky-rocketed,
4. The State and Federal programs to assist these families have sky-rocketed,
5. The number of family counselors anf therapists have sky-rocketed,
6. The number of lawyers and judges required to sort the mess out have sky-rocketed,
7. The crime rate among young people has sky-rocketed.

Not bad for a simple little affair of the heaart. I wonder what happened to personal responsibility and commitment. I thought those were supposed to be conservative values.

That's your opinion. You are entitled to it. I'd be willing to bet that the "simple little affair" you mention is actually anything but. Some people just don't do well together after a point. Just so you know, I happen to be a happily married guy w/ a bunch o' kids, but I do know some guys and gals that live in agony. Perhaps it may be as simple as saying to one's spouse, "..if you don't stop, cease, and desist from all of your bitchin', moanin', and complainin' IMMEDIATELY, I'm outta here..." I say that there always two sides to every story.

I believe you missed my point. Allow me to clarify. There is no such thing as "simple affairs of the heart" when marriage and families are concerned. There are consequences to actions. These "affairs of the heart" often leave peoples lives in complete disarray.

I am not proposing that divorce be eliminated, only that marriage and family be encouraged.

When a spouse wants a divorce because they are unable to get along with the other spouse, do they have to get a girlfriend or boyfriend first?

That's got MY vote. Let's take on appointed judges while we are at it,too. Who the hell died and made judges God,where they actually have the power to put you in jail for not respecting them? Respect is a thing that is earned,not mandated.

Yeah, it's true that some spouses are hard to get along with. Part of me actually believes that folks who choose that poorly should be required to spend 10 years imprisoned with the creep just to make them think about what marriage is all about.

I don't have a lot of sympathy for those who have kids, though. These immature "adults" who cheat, connive, choose poorly, run around, etc. then dump their wasteland all over the rest of society should pay through the nose. Their kids have incredibly high rates of costly anti-social behavior.

And then we have to pay the costs for these scumbags...both of them...so I'm not sympathetic toward either. They should keep their mouths shut, do their duty, raise their kids, and then when the kids are out of the house, if they still haven't managed to grow up, then they can divorce.

But a cheating partner should have to pay as should the partner of their fling. I could care less if they're starved for LUUUUVV.
