What are the legal requirements for treason?

Treason is an action rather than just talking. What he is doing would be more along the line of sedition.

It would be helpful if we would declare war. I have no idea why it is to Bush's advantage not to declare war. Congress was willing and Bush asked them not to.

That would be an interesting string to pull. What about being in a declared war is disadvantageous to the presidency?

Deporting Muslims who are here illegally is already doable--that would significantly reduce the threat from Muslims within the country--immigration laws allow that.

But if war were declared, and self-styled "peaceful Muslims" were actually making claims such as this individual, what legal threshold would have to be crossed for arrest for "sedition" to occur?
