CLAYTON COUNTY, Ga. — A Cartersville man said ICE agents wrongly detained him at Hartsfield-Jackson Atlanta International Airport.
The American citizen told Channel 2’s Ashlyn Webb that he’s still shaken by what happened.
John Phillips had made it through TSA, had his ID checked and went through facial recognition before agents stopped him as he was boarding, he said.
“I’ll never approach a door of an aircraft without wondering if there’s guys standing back there,” he said.
It was supposed to be a routine work trip to Las Vegas, but a Delta agent told him the airline was working to upgrade his seat.
He just needed to board last.
Phillips says three ICE agents in tactical gear stopped him in the jet bridge, pinned him to the wall and put him in handcuffs.
He says he didn’t resist but told them he was an American citizen.
“They cuff me and start asking me, ‘What’s your name? What’s your birthday?’” he said.
He says after about five minutes in handcuffs, agents found his Georgia ID and showed him a picture of the man they were actually looking for.
“He looks nothing like me, other than that he’s a white guy and I’m a white guy,” Phillips said.
Agents told him the other man was from England but shared his name and birthday.
Immigration attorney Charles Kuck said ICE still must have probable cause to make an arrest.
“There is no probable cause here. A matching name and birth date is not probable cause,” Kuck said.
Phillips now wants to know how this happened.
“I just am flabbergasted that all of the security that we have at the airport, that they don’t know that I am the John Phillips that lives in Georgia and is not an English guy,” he said.
Delta released a statement which read in part:
“Delta employees do not have insight into or control over law enforcement decisions, and our role is to ensure flights operate safely and customers are treated with respect. We are reviewing this event internally and are reaching out to the customer directly.”
ICE confirmed the incident and shared a statement with Channel 2 Action News that read:
ICE conducts targeted enforcement actions based on investigative leads and available identifying information. In this instance, officers briefly encountered an individual at the airport during an ongoing enforcement effort. After additional verification determined the individual was not the person sought, officers promptly released him.
The encounter occurred outside public view to minimize disruption to airport operations and protect the individual’s privacy. ICE takes seriously its responsibility to conduct enforcement activities professionally, lawfully, and with appropriate safeguards.
For operational and privacy reasons, ICE does not discuss specific investigative details or information involving individuals who are not taken into custody.

So they checked the guy and after a short term delay determined he was not an illegal alien. Then they let him go on his way.
This is the very definition of a nothingburger.
Why did they handcuff him though before verifying his identity? There are probably thousands of guys with that Name. That’s not ok.

The government floods the country with millions of criminals, then treats all the regular citizens as suspects. They make crime so bad that people will beg to have their freedoms taken away for a little more security. This very FR thread will likely have fans of Big Brother’s facial recognition system.
And to think there was some retard on here last week defending Flock cameras.
They handcuff ppl all the time. For example, when there’s a warrant or just to detain them while they check out their ID/story. No biggie really.
They pinned him to the jetway wall and cuffed him. That’s a little more than a slight delay in my book, but you do you.
Crime is a nothingburger because it’s committed by government agents? This appears to have been a false arrest. That’s not a nothingburger ... it’s a crime, and should be treated as such.

Balderdash.... looking, dressing, speaking Hispanic and origin-destination should be allowed as another “cause”....the only reason it is not is a BS SCOTUS opinion meant to protect thugs in thug dress...not guys who look like Denzel or Barack.

Sadly, it’s more than one. Too many think those things are a good idea.
Mistakes do happen. They thought he was an illegal. It turned out he was not. The mistake was caught pretty quickly and he was released.
Once during a traffic stop, the officer transposed a couple of numbers on my driver's license. It came back as some guy who had an outstanding warrant. I was cuffed, taken to the holding cell and had to wait there for 4-5 hours. Yes it sucked. No I was not happy about it, but that was not a crime. It happens sometimes.
He had to wait 5 whole minutes before they saw his Georgia ID and the whole thing was straightened out? How will he survive????
They detained him briefly, discovered the mistake and released him. Big deal. I've had worse. You don't see me crying about it.
The cuffing seems a bit extreme, but we do not know the nature of the person they were trying to arrest.
He made his flight, so in the end really is not a big deal other than the need to scale back on the cuffing thing, UNLESS they guy, they wanted was some kind of international murderer.
Also, the whole facial recognition thing needs to stop, never been a fan of that. To many ways for it to go wrong with no accountability. Stop the person pull out a photo and compare, do your freaking job as a cop already.

I think it’s more than “briefly encountered”, too — a cute little phrase to downplay a traumatic incident.
I can say “thank you” to TSA agents who scan me, but being handcuffed capriciously would be different. That facial recognition is crap.
just gunna say, there are tens of thousands of John Phillips out there. Maybe even a hundred thousand in the US. That means the likelihood of there being two of them with the same birth date is very low. Because there are likely a hundred with the same birth date. You got to have more than that. Mary Hall, Jennifer Schmidt, Jose Rodriguez. You can’t go on name and birth date. Did they ever live in the same place or is their phone number the same. Birth date is not nearly enough with a common name.
