In WA State you cannot discriminate based on gender expression or gender identity. Local fools amended the state constitution to make gender identity or gender expression a protected class. There is no test, such as transitioning, hormone treatments, “life experience”, or anything. You say you are a woman or man at any given moment, and that’s what you are.
Seattle Storm will have to move states to avoid hiring one of these ex-NBA “women.” They could play a game as a woman and then go out clubbing as a man, nothing in the law prevents that. Their gender expression does not have to be enduring. Switching back and forth is fine and protected the same as race or religion.
A traditional Korean style (nude) female only spa lost their case to prevent trans from coming in, and their only rule was no penises allowed (surgically transitioned trans were welcome). The weirdo who sued them and won, was a fat dude with a beard who made no effort to appear female or transition.
Seattle Storm will be the next WNBA champs.
