National Association for Gun Rights warns the move could derail momentum toward a U.S. Supreme Court challenge to “Assault Weapons” Bans and magazine bans nationwide. A growing controversy is unfolding after the U.S. Attorney for the District of Columbia, Jeanine Pirro, signed onto a Department of Justice brief seeking to revisit a major pro-Second Amendment ruling from the District of Columbia Court of Appeals.
The case, Benson v. United States, recently resulted in a three-judge panel striking down Washington, D.C.’s magazine ban, marking a significant legal victory for gun owners and a potential stepping stone toward broader challenges to “Assault Weapons” Bans and magazine bans nationwide.
The ruling is especially critical because it creates a pathway for the Supreme Court of the United States to weigh in on semi-auto firearms and magazine bans — an issue that has remained unresolved at the highest level.
However, the Pirro and the DOJ’s latest filing requests an “en banc” review, a legal process in which the full court rehear the case, potentially overturning or narrowing the pro-gun decision.
According to the National Association for Gun Rights, this move could stall or even eliminate the chances of the United States Supreme Court taking up the issue in the near future, particularly as similar cases from other states are already positioned for review.
Pirro’s request is especially troubling given the DOJ’s recent shift in position. After previously defending enforcement of the magazine ban, federal attorneys under the current administration argued the law was unconstitutional — an argument the appeals court ultimately accepted.
Now, the push for reconsideration risks undermining that victory and preserving the legal framework for future enforcement of similar restrictions.

Trump needs to pick his DOJ appointments by something other than how they look in a skirt.
He does seem to believe a good looking woman is competent and capable and has the right heart.
“Good looking” means nothing with any of that.
This happens when you have people who come from a culture that assumes that any mere “citizen” in possession of a firearm must be a criminal because no one but the police has any need to have them.
This is also why red state departments should not fall all over themselves to hire cops away from places like NYPD. They this attitude ingrained in them.

I agree this looks like a bad move. But I don’t know all of the details. Maybe this guy’s opinion is right. Maybe it’s not. Not ready to make a decision - ready to hear more information.
Pirro has always been a NYS RINO.
Beyond that one of the biggest challenges for the second amendment is that so many Republican politicians are former prosecutors andvdeep in their guts they don’t really support gun rights. They liked having all those little prosecutorial toys in their toy box to use to win cases. So when they move on to another office, they have trouble adjusting to a pro freedom mindset

“You bring a gun into the District [of Columbia], you mark my words: You’re going to jail. I don’t care if you have a license in another district, and I don’t care if you’re a law-abiding gun owner somewhere else. You bring a gun into this district, count on going to jail and hope you get your gun back.”
You can argue that she’s simply stating the law, but there’s more to it than that. She sounds like a cheerleader and excited to throw someone in jail. She does not sound like a 2nd amendment supporter at all.
Fire all TV commentators in the administration. Any and all. Worthless mouthpieces.
She is following the law. The law is the problem, not the one enforcing the law.

Pirro’s office can still prosecute possession of unregistered firearms, carrying without a license, and illegal possession of ammunition if she wishes. The fact that those offenses are still a priority for Pirro’s office isn’t a concern for the public defenders, at least in Benson’s case, but they’re central to the complaints by Second Amendment advocates that Pirro’s stance puts her at odds with President Trump’s executive order on protecting the right to keep and bear arms.
