North Dakota Supreme Court Upholds Abortion Ban

The North Dakota Supreme Court on Friday restored a near-total ban on abortions, delivering a major victory for pro-life advocates who hailed the decision as a critical step in safeguarding unborn children across the state.

In a 3-2 ruling, the high court found that the state’s pro-life law banning abortions, enacted by the Legislature in 2023, remains constitutional, rejecting a lower court’s earlier decision to strike down the law.

The measure, Senate Bill 2150, classifies killing a baby in an abortion as a felony punishable by up to five years in prison and a $10,000 fine. Exceptions are permitted only to save a patient’s life or protect their health, and such rare abortions must occur in hospital settings.

Attorney General Drew Wrigley, a Republican, praised the outcome as an affirmation of the people’s will.

“The Supreme Court has upheld this important pro-life legislation, enacted by the people’s Legislature. The Attorney General’s office has the solemn responsibility of defending the laws of North Dakota, and today those laws have been upheld,” Wrigley said.

State Sen. Janne Myrdal, R-Edinburg, a longtime pro-life leader who sponsored the bill, expressed deep gratitude for the court’s recognition of the law’s protections. She described herself as “thrilled and grateful” that two respected justices affirmed the measure as “fully constitutional, protecting both mothers and unborn children.”

Myrdal has long championed the legislation, noting that “North Dakota has always been pro-life and believed in valuing the moms and children both.”

The law, signed by then-Gov. Doug Burgum on April 23, 2023, after overwhelming legislative support — passing the House 76-14 and the Senate 42-5 — aims to protect unborn children throughout gestation.

Myrdal added at the time, “We’re pretty happy and grateful that the governor stands with that value.”

The legal battle began in July 2023 when the Red River Women’s Clinic abortion business in Fargo sued Wrigley to block the ban from taking effect. In September 2024, Burleigh County District Judge Bruce Romanick ruled the law unconstitutional, arguing it infringed on women’s rights to procreative autonomy and was not narrowly tailored to promote health or protect fetal life.

The state swiftly appealed, with Solicitor General Phil Axt arguing before the Supreme Court on Nov. 21, 2024, that the district court had overlooked North Dakota’s longstanding interest in preserving life.

“It’s been clear since our territorial days that in order to justify killing another human being, there must be a threat of death or serious bodily injury,” Axt said.

In January 2025, the Supreme Court denied the state’s request to enforce the ban during the appeal, but Wrigley emphasized that the ruling addressed only the procedural stay, not the law’s merits.

Chief Justice Jon Jensen and Justice Jerod E. Tufte dissented from the stay denial, contending that the district court’s opinion contained significant legal errors and that the state constitution’s framers did not intend to enshrine abortion rights.

The full appeal was heard on March 24, 2025.Friday’s decision, which requires at least four justices to overturn a law, saw only three — including Justice Daniel Crothers — find the ban unconstitutionally vague, particularly regarding exceptions for maternal health. Crothers noted, “The vagueness in the law relates to when an abortion can be performed to preserve the life and health of the mother.”

With the justices upholding the law, the ban takes immediate effect, effectively making nearly all abortions illegal in North Dakota once again.

North Dakota has not had a surgical abortion clinic operating within its borders since 2022, when the Red River Women’s Clinic relocated to Minnesota.
