COLUMBIA, S.C. (WIS) - A man arrested after a crash that killed a University of South Carolina student earlier this year is now serving a prison sentence.
Public court records show Rosali Fernandez-Cruz pleaded guilty to a count of hit and run resulting in death on Aug. 11. He was sentenced to one year in prison, with credit for 131 days served. Records from the South Carolina Department of Corrections show he is scheduled to be released in March 2026.
The count was related to an April 2 crash in which Fernandez-Cruz hit 21-year-old Nate Baker while driving a truck at the intersection of Blossom and Assembly streets.
Baker, who was riding a motorcycle, died after being taken to a hospital. Originally from Virginia, Baker was a junior business major at USC at the time of his death.
Fernandez-Cruz, meanwhile, was later identified by authorities as an undocumented migrant from El Salvador who entered the country as a minor in 2016. He was also wanted by the Bureau of Immigration and Customs Enforcement at the time of his arrest for failing to appear in court in 2018.
SCDC records show Fernandez-Cruz was booked into the Kirkland Correctional Institution on Aug. 14. Court records also note that three other counts he was charged with in connection with the crash that killed Baker were dismissed.
This is disgusting.
One year in prison with credit of 131 days for time served?
Undocumented means illegal that came in through and under the joe biden’z open border welcome sign.
What the HELL is wrong with SC?
* Sentenced to one year in prison less time served 131 days
* Will be released March 2026.
* Fernandez-Cruz killed 21-year-old Nate Baker while driving a truck
* Undocumented migrant from El Salvador
* Entered the USA as a minor in 2016
* Wanted by the Bureau of Immigration and Customs Enforcement at the time of his arrest for failing to appear in court in 2018.
Bastard gets ONE YEAR in prison in exchange for murder!
Two of us were talking about the rapper who got four years for his crimes and the government wanted eleven years, and I said people who kill someone are getting less than that.
“”it’s California, after all””
Easy to understand why you would say that but this is not USC in CA - it’s South Carolina
Richland County (where this took place) is in the blue Sixth district. And knowing this is where a Biden judge got her seat because her husband was the Columbia mayor until 2021, I can assure you those attorneys protected him via “right to dignity”.
The Fourth Circuit, which is the Federal Appeals Court here, is run by Washington, DC.
The Sixth is the largest district by size, run by Clyburn.
Didn’t just hit him. He hit him and RAN AWAY.
This is a total miscarriage of justice. Do illegals now have special “get out of jail free” cards much the same as trans-crazies do?
An American citizen would get 10 to 15 years for such a crime.
What does the victim, 21 year old Nate Baker, feel about this sentence?
He's dead so he can't comment.
Ask that despicable Jessica Tarlov or Joy Reid or the other excuse makers for the illegals.
Illegals can't commit crimes and kill Americans if they are kept out of the US.
“”””He was sentenced to one year in prison, with credit for 131 days served.””””
Yeah, that will put the fear of the Lord into criminals who do criminal acts.
Imagine what poor Nate’s mom, dad, brothers, sisters, girlfriend, wife, kids, etc feel about this. It absolutely sickens me.
* Undocumented migrant from El Salvador Bastard gets ONE YEAR in prison in exchange for murder!
Me, too.
May God help them in their sorrow.
That’s what I was thinking too.
I'm all for that if at the end of his one year "sentence" he is hanged by the neck until dead.
If I was Daniel Baker, I would support this cretin’s release. Just sayin’.
