There's the problem ... they over-charged, and got their asses handed to them. Charge him with misdemeanor assault and battery, and I bet you can get a conviction and put him in the lock-up for a few months.
Juries suck almost as bad as shyster lawyers and worthless judges. This country’s judiciary is a friggin’ joke.
They need to find a new grand jury. DC is corrupt.
Thugs can throw acid at someone’s face and disfigure them permanently.
They can throw fireworks and cause serious burns and other injuries.
They can throw a frozen plastic bottle at someone’s head.
They can throw a glass bottle or a brick at someone.
Not a lawyer, but I believe a Grand Jury is required in Federal cases. In any case, he lost his job and he did get the ride. Even loss of blood might not move a DC grand jury to indict, let alone a DC jury to acquit any anti-Trump act.

Felony assault with a sub? Sounds more like disorderly conduct or some similar offense.
Of course, the sub undoubtedly ended up on the ground, so maybe felony littering?
These jerk “juries” are the reason DC is a septic tank full of criminal floaters.
I mean, the 'guy' was on film chucking and hittimg the officer with the sub.
I’ll bet if someone hit one of the friggin jurors with a sandwich, we’d be seeing a trial.
