Judge Dismisses DOJ Lawsuit Over Chicago’s Sanctuary Protections for Immigrants

A federal judge has dismissed the Trump administration’s lawsuit against Illinois and Chicago over sanctuary policies that the government has said interfere with federal immigration enforcement.

In a ruling released Friday, U.S. District Judge Lindsay Jenkins said the government lacked standing to override local laws that limit cooperation and information-sharing between law enforcement.

Jenkins said the government doesn’t have the legal authority “to commandeer states under the guise of intergovernmental immunity.”

The Justice Department didn’t respond to a request for comment.

Standing is a wonderful word. It seems to cover everything a judge does not want to deal with, or cover up.

Haven't we been down this road before with some ensuing unpleasantness?

South Carolina, led by figures like John C. Calhoun (then Vice President under Andrew Jackson), championed the nullification doctrine. This theory, rooted in states' rights, asserted that states had the authority to nullify federal laws they considered unconstitutional within their borders.

In 1832, South Carolina passed an Ordinance of Nullification, declaring the tariffs of 1828 and 1832 null and void within the state and threatening secession if the federal government attempted to enforce them. President Andrew Jackson, a strong advocate of federal authority, responded forcefully: he issued a Proclamation to the People of South Carolina, asserting the supremacy of the federal government and declaring nullification an act of rebellion. He requested and received Congressional approval for the Force Bill (1833), authorizing military action to enforce federal law in South Carolina.

And we were off to the races over the next 28 years.

It isn’t the lowly beat cop who is protecting illegals, most would love to drop a dime to ICE. The problem is the DEI brass within the department who are beholden to the democratic machine for their positions, and carry out their leftist orders.

The supervisors need to be charged as conspirators in covering up evidence of the crimes.

Charge them under RICO. The first one to talk gets the deal. The rest get sentenced.

Correct decision. The fed can’t commandeer states to enforce federal law. States, counties and Indian reservations are sovereigns. It’s part of our federal system.

The federal government “lacks standing” to enforce federal immigration law? That’s a new one. This reminds me of the 2020 election lawsuits that were dismissed for “lack of standing.” For these smelly judges, the only people who have “standing” are illegal immigrants.
