The judge is correct. The Alien Enemies Act requires an act of war an or invasion by a foreign nation or government. Although Trump correctly designated Tren de Aragua as a foreign terrorist organization, the gang is not a foreign nation or government.

Theyre doing it right now with DOGE. Trump knows this. That is why this first 100 days was so important for Trump to disrupt status quo as quickly and forcefully as possible. These judges have limited scope and wont stop him on most fronts. They will run out of avenues to slow him down. Trump seems like he has no intention of changing gears and is primed for the fight. Good luck to his enemies.

What the heck? Time for that overhaul of the judicial system to weed out judges like this.

...or invasion by a foreign nation...

That is precisely what a mass influx of people who illegally bypass the due process of immigration happen to be.

They are here illegally.
What more authority does he need to deport them?

Republicans, get off your butts and pass a law calling for the summary removal of all illegal aliens. And do not say that you cannot do it. You can if you really wanted to. Just look how Obama Care was passed.

The implementation of the act states the terrorists are being sent with expressed consent and assistance of the Venezuelan govt.

RE: ...Time for that overhaul of the judicial system to weed out judges like this.

Famous line from John Wayne in McLintock.

https://movie-sounds.org/western-movie-quotes/quotes-with-sound-clips-from-mclintock-1963/do-you-know-what-a-cull-is-ma-am-a-cull-is-a-specimen-that-is-so-worthless-that-you-have-to-cut-him-out-of-the-herd#google_vignette

“John Wayne’s character George Washington McLintock uses the phrase “cull the herd” to describe removing a worthless or undesirable person from a group. He then uses the term to refer to Governor Humphrey, whom he considers worthless.”

They need a bigger rope.

Culling the Deep State within the 3 Branches might require the US Military..

“The President cannot summarily declare that a foreign nation or government has threatened or perpetrated an invasion or predatory incursion of the United States, followed by the identification of the alien enemies subject to detention or removal,” Rodriguez wrote.

The President didn't "summarily declare" it. He responded to the fact it was and is happening.

Is it just me, or do others find the idea of a judge “ruling” this or that offense?

In a self-governing republic, we don’t have lords, rulers and dictators, we have representatives, judges and presidents. So they should represent, judge and preside. The verbs we use should fit the titles. IMHO.

“The President cannot summarily declare that a foreign nation or government has threatened or perpetrated an invasion or predatory incursion of the United States”

Umm..sure he can

It’s the whole point of the Act

Yes...and he built a lot of that almost entirely on his own efforts, with zero help from his own party. I thought what he got done was remarkable, given how much he got done with no help.

"This will be thrown out eventually."

EVENTUALLY. is the operative word and GOAL of Lawfare. The delay neuters DJT as the POTUS, while the complicit USSC fails (intentionally) to act in accordance with the Constitution.

ALL this lawfare will be settled in a couple years, IF the Democrats can Fraudulently seat a few more Congress and Senate stooges(both Dem's and RINO's) to re-write the "Law" to suit the Agenda.

True. It will make DC a ghost town until the good people come in.

Fine. Just do what the Deporter-in-Chief Barracks Soetoros did and deport them without invoking any Act.

Did the Judge ever wonder why the President has the sole authority to launch ICBMs without a Congressional declaration of war?

Only Congress can declare a war.

BUT

The President can recognize a war, and respond to that reality.

what I really hate is that even though its grossly unpopular, the dems are defending the right of illegal alien criminals to stay in the country. They will likely lose that but the point is not that that they win that fight but rather that they force the republicans to draw the line at illegals criminal aliens. what part of the 20 million or so who came over the border are criminal aliens? 10%?

That’s not a big percent. They are small enough to be sacrificial pawns. After placing so much emphasis on the criminal status of illegal alien criminals—it will be harder for republicans to go after the illegal aliens who have not broken the law. All of these people will be democrat voters.

That’s how the game is shaping up right now.
