The Legacy of the Roberts Court
American Thinker ^ | April 23, 2025 | Robert A. Taft

Posted on 04/24/2025 3:16:15 PM PDT by george76

John Roberts .. and his court will go down in history as increasingly unconstitutional as they emplace double standards on due process and free speech, lawfare, interference with Article II, and political campaign financing, to name a few.

...

Due Process and Free Speech

In June 2024, the Roberts Court stepped in on the January 6 matter to say prosecutors improperly charged some J6 defendants. But this was four years after American citizens, mostly charged with misdemeanors, had been held in the worst of prisons. Not once did the Supreme Court even send a memo to the sentencing Washington judges to support the rights of the J6 prisoners. Conversely, in this period of massive illegal immigration, the court quickly put a temporary restraining order on Trump’s deportation of illegal and lethal gang members, claiming their right to free speech and due process has been violated.

...

Roberts is a 2005 appointee of Republican George W. Bush, who is a staunch globalist like his predecessor Bill Clinton and successor Barack Obama.

...

President Trump was elected largely on his promise to rid the country of the millions of illegal migrants who invaded the U.S. under a complicit Biden administration. When Biden deliberately opened the border floodgates to unvetted illegals, fentanyl, child molesters, murderers, and other criminals, the Supreme Court found nothing wrong with his actions or the vast amount of money it was costing American taxpayers.

But when it comes to ridding the country of these people, the Supreme Court is quick to prevent deportations from happening. Has Roberts forgotten that the triad of globalist presidents Bush, Clinton and Obama deported 28 million illegals without any injunctions. Trump has deported 100,000 with 30 injunctions. Why is that?

Roberts’ Court: Inventors of Infinite Process.

Due process not enough.

Article 1, Section 9 is an option for Trump if the SCOTUS refuses to rein in the Circuit courts.

The judiciary is not respected by democrats or the left. It is only a useful tool for them. Republicans and conservatives on the other hand had respect for law and the courts. However, because of all these leftist, corrupt and activist judges, the judiciary is losing support from the one group that had respect for it. It will not be long before the judiciary has zero support from the people it is supposed to serve. And the Robert’s court appears to be doing what it can to help this process along.

John Roberts .. and his court will go down in history as increasingly unconstitutional

That old cliche again. Everything that will "go down in history" depends upon the historians.

The current ones have written a shelf of books about Trump being impeached, Trump the felon, Trump in the sights of lawfare judges, and Trump the new Hitler.

David Brinkley, Jon Meacham, Doris Kearns Goodwin and a long list of them hate Trump and love the Left. The majority of college students who even have classes in American political history use A People's History of the United States by Howard Zinn and finish it knowing woke is the way to go.

I hope if Trump gets more Supreme Court picks that he gets better advice than he got at #45.

Dump all the illegals on his door step.

Get a judge to declare an injunction on him removing them.

Well it’s too late. Trump seated 2 trojan horses and a center left replacement for Scalia. Thomas is the most likely opening so no help there.

Here is law professor Glenn Reynolds’ (Instapundit) opinion piece from yesterday.

“Alito’s right to warn: Court’s knee-jerk habit of slapping Trump will cost it dearly”

https://nypost.com/2025/04/23/opinion/alito-is-right-courts-trump-scorn-will-cost-them-dearly/

This sentence nails it:

“The judiciary has neither the sword nor the purse, only judgment and reputation. If it abandons its objectivity for partisanship, what reason is there to heed it?”

What’s hilarious is the two best justices on the court — AJ Thomas and AJ Alito — were appointed by notorious globalist deep state lackeys Bush 1 and Bush 2

Roberts has turned out to be awful via Bush 2

And it seems people hate the Gorsuch, Kavanaugh and Barrett picks — from Donald Trump

Funny how that all turns out

Trump’s first term was largely wasted. He is doing somewhat better this time but it is trending more in the direction of making the same mistakes.

Kash and Bondi are shaping up to be huge disappointments. Trump had some good initial wins with congress but doesn’t know how to use it against the courts. After some initial successes Trump is now surrendering to the judiciary.

Tulsi is looking like one of his better appointments. Kennedy is too timid at this point. Rubio and Zeldin are looking pretty good.

President Trump should declare martial law due to an invasion of illegal foreigners and arrest EVERY judge who has backed this unlawful invasion and violated the President’s Article II powers. Send all of these arrested judges to GITMO to await trial by military tribunal for sedition against the USA.
