Supreme Court temporarily halts more Venezuelan detainee removals under Alien Enemies Act

The U.S. Supreme Court temporarily blocked the removal of Venezuelan detainees accused under a wartime law of being foreign gang members early Saturday morning, after the ACLU argued the men were at risk of imminent removal to an El Salvadoran prison ....

Justices Clarence Thomas and Samuel Alito dissented.

He had almost no choice. Mitch McConnell refused to go into recess the entire Trump Presidency. So he HAD to choose someone Mitch approved of. Zero choice. He recessed for Obama, but not for the president from his own party.

I have thought along the same lines. I don’t know where Trump could get a qualified true Conservative for the SC at this point if an opening occurs.

I thought the Alien Enemies Act was non-reviewable. Judicially that is. The SC shoulda tossed it on those grounds with a ruling of reprimand to lower courts.

I could be wrong about it. But I know I’ve read that several times when that Bassturdberg was making his stupid rulings.

Four Republican appointed justices voted against the administration. What was the legal reasoning?

The very deep behind of scenes of this goes all the way back to the US war against the Barbary pirates (1801-1815). The wooden ship US Navy had been sent to Africa, where it had divvied up the waters there with the (still mildly hostile) British Navy into different jurisdictions.

However, arrogant US federal judges insisted that any US ship capturing such pirates had to stop what it was doing, and bring them to the US to stand trial, wasting many months in transit.

But the US Navy was smarter than that. The British Navy was permitted to hold pirate trials aboard ship, and when convicted, to hang the pirates on their own pirate ship which was being slowly scuttled. So US ships’ captains would check their navigational charts and discover that the pirates *just happened* to be captured in British jurisdiction. So in a spirit of cooperation, they “had” to turn over the pirates to the British.

I would measure to guess that the US federal judges were not happy to learn of this.

This is a ridiculously narrow idea of Constitutionality. When the direct interpretation of its prescriptions for judicial procedural due process are in conflict with its purposes as stated in the Preamble, justice, defense, liberty, and tranquility all suffer.

THAT is how the legal system as such falls afoul of its habitual legal approach to jurisdiction. This was predicted by many of the Founders, to which sufficient numbers took objection as to propose the original 13th Article of the Bill of Rights: Titles of Nobility and Honor (TONAH), the Constitutional ratification of which was then ignored.

So with the stroke of pen, Biden can allow 5 million illegal immigrants into the country as a class, allow them to stay, and illegally receive benefits.

but when Trump wants to remove them, they must be treated individually, which of course, the system was never designed for

Roberts is now makkng the power play of his life.

He KNOWS that. But he is seizing the power anyway.

Trump should simply invoke his own authority, pile another 2000 terrorist trash onto C-17s and dump them into CECOT.

Then declare War on Venezuela and let Pope Roberts try to nullify him on that.
