He was wearing a hoodie reflecting MS-13’s motto, “hear no evil, see no evil, speak no evil” (Dollar bills with the presidents on them having their eyes, ears, and mouth covered). And he was wearing a Chicago Bulls hat, which is one way the gang identifies its members in good standing.
The hat alone wouldn’t be enough to conclude too much about him, but that hoodie is another thing.
I’ve looked at a lot of images, trying to find ANYTHING that has a President’s eyes, ears, and mouth covered up and I cannot find anything at all that is like this. Sometimes the mouth is covered, sometimes the eyes goofy, but nothing with all 3 covered. This had to have been custom-made for him.
By the time you combine the name and rank given by the previously-reliable and accurate confidential informant, the company he was with (and when ICE arrested him they had a photo of him playing basketball - apparently with MS-13 members - and the name of a restaurant he frequented., and the questioning they did of Garcia and another MS-13 leader in a murder investigation they were doing regarding a murder eventually proven to have been arranged by MS-13 members of the same rank as Garcia and carried out by them and some lower-level MS-13 people.... that says a lot.
Now we can also factor in 2 protective orders his fiance’ got against him - one in 2020 and one in 2021 - because of the violence towards herself and their child. Part of the conflict in at least one case was because she wanted the use of her car but he needed it for “something”. We know that in 2022 he was caught in TN driving without a license, speeding and swerving out of his lane while transporting 7 people from TX to MD. He pretended not to speak English and the people he was transporting had no bags, listed his home address as their address, and couldn’t write clearly enough for the police to read the writing. It was then that the police officer found that he was on a terrorist watch list But when they contacted the FBI Biden’s FBI told them to let him go and not charge him with anything.
Add into that his traffic violations that he admitted he knew he needed to appear in court for but didn’t (gang members stay as far from law enforcement as possible because they will be suspected of being an informant) and his refusal to get his temporary license renewed even AFTER he was doing his check-ins with the immigration court folks starting in 2019 (the license was expired in 2022 when he was caught doing suspected human trafficking.
The long and the short of it is that 2 immigration judges gave him due process and the chance to contest the gang affiliation. He was always deportable because he had entered the country illegally and hadn’t applied for asylum within a year of entry. When he got caught he pleaded that the old gang he claimed to have been running away from in El Salvador would harm him if he was deported back home - although I read that he claimed his family had moved to Guatemala to try to get away from the gang but the gang had followed them. So perhaps his “home” (if you count where he was living and not where his citizenship was) would have been Guatemala.
On another thread I posted links to investigations that this gang unit of Prince William’s County had worked on and the kinds of info they had. They recognized the lower-level MS-13 member at the Home Depot parking lot right away because he had quite a rap sheet. Gang members are only supposed to hang around with other gang members so it made sense for them to ask the confidential informant who these people were. In addition, several of the guys in the parking lot threw containers of marijuana under cars when they saw the police coming, and they also threw something else too though the report didn’t identify what it was. When they found the names and ranks of these people they questioned Garcia and the other higher-level one about the murder that had been committed in the county the month before.
In the case of the Venezuelan Tren de Aragua members the cry was that they had never had immigration hearings. Well... in this case Garcia DID have hearings where it was decided that the evidence was convincing that he was MS-13 and he was deportable. The reason he didn’t have a criminal record as of this year is because battery charges were not filed against him when he repeatedly abused his wife and son and because the FBI stopped any charges from being filed for human trafficking - and indeed stopped there from even being an investigation of that. He WAS cited for traffic violations, and he didn’t show up to court to resolve those.
He married his fiance’ at the time when being married could cause a judge to think he was not as much of a flight risk, when he was trying to get out on bail.
The police now are saying that he also had gang-affiliated tattoos. They said in the report that his left arm had a tattoo of a child going up stairs. That’s the tattoo that his wife recognized him by, in the footage of the prisoners in El Salvador. She also recognized scars, and I would be interested to know what all scars he had; the initiation to be in the gang involved killing a rival gang member (which is what that murder investigation was all about), being voted in by the clique, and then going through a slowly-counted 13 second beating by the group. So scars could also potentially be evidence; he claimed that the gang followed him in El Salvador but not that he was beaten by them.
The gang he feared in El Salvador is all in CECOT now. The reason to not deport him to El Salvador no longer exists. The administrative error the Trump administration made was in not getting that hold removed first OR not sending him to Guatemala which was the last location he said he had lived with his family as a youth. They say that as the list of people slated for the CECOT flights was revised, the note saying Garcia wasn’t supposed to go to El Salvador somehow didn’t get transferred to the new list.

Chequeos are mid-level soldiers. The other chequeo with Garcia had a tattoo of the devil - with horns, which was only allowed for a leader of some kind - in his case probably with his clique. The particular clique that that guy belonged to has adherents in different locations, based on another long report I read about MS-13.
She probably has not spoken to the confidential informant, who more than likely testified under seal to the other judges. Her court case is not about whether he is MS-13. Her court case is about what SCOTUS said it was about: specifically, to define what “facilitate” means. And she refuses to do that. DOJ said that in the absence of her SCOTUS-required definition, they operate under the commonly-accepted definition of removing any obstacles which would prevent the desired outcome. And there are currently no obstacles to the desired outcome - except that Bukele says he is not going to smuggle into the US what the US has already defined as a terrorist. SCOTUS forbids Xinis from negotiating foreign affairs such as the arrangements regarding how to handle terrorists between nations.

Gang member or not doesn’t matter since he also entered US illegally in 2012, has had numerous law violations, assaulted wife/mother of children to where she filed restraining order detailing attack by him, he also had 2022 issue with trafficking 8 people with no drivers license.
Who cares about all the reasons when any one will do, since he walked in illegally and stayed and now we have a president enforcing existing border rules and laws.
Illegal is illegal.

Garcia’s claim that he couldn’t have been part of the Westerns clique because that is in New York where he’s never lived ignores the East Coast Program, which is a conglomeration of the individual cliques on the east coast, as they cooperate to do their crimes. At https://www.dea.gov/press-releases/2019/09/09/founder-and-leader-ms-13-clique-trafficking-guns-arming-gang-members it describes the head of that project traveling between New York and Maryland to coordinate crimes and to distribute weapons from Florida to the cliques all around there.
Another article I read said that MS-13 spread north from Prince William’s County. New cliques can only be created by a clique member in one area moving to another area. So every clique that exists in a new location is the ‘baby” of a member from a different area.
The whole thing makes me wonder who created the clique in Hartford County, which is northwest of Baltimore County. Hartford County is where Rachel Morin was raped and killed by an MS-13 member. An article from 2017 mentioned that Baltimore was becoming infiltrated by MS-13 spreading out from Prince William’s County. This is part of what the program leader does; they try to spread out their network so they can increase their extortion rings. Cliques are said to control a certain geographic area, but they start from somewhere else and they have some coordination with other cliques also, via the program leader.
