Can RFK Jr. ban pharma TV ads?

TALK TO YOUR DOCTOR ABOUT PHARMA ADS — If you believed everything you read on social media, you’d think HHS Secretary Robert F. Kennedy Jr. had issued a sweeping proclamation Monday morning to ban prescription drug advertising on TV.

That was the chatter on social media platform X from a prominent retail trader account, prompting Prescription Pulse sources to reach out and wonder what they were missing. Turns out, it wasn’t much.

“The social chatter you are hearing that HHS banned pharmaceutical advertising is not accurate,” HHS spokesperson Andrew Nixon told us.

In 1970, Congress took their anti-smoking initiative one step further and passed the Public Health Cigarette Smoking Act, banning the advertising of cigarettes on television and radio starting on 2 January 1971. In April 1970, President Nixon signed it into law.

The Fairness Doctrine got them banned on radio & tv and became defunct 20 years later, so no it would not be the same controlling legal authority.

When the first TV Big Pharma ads were allowed there were honest, ethical medical doctors left who said “Why exactly am I supposed to prescribe something because a patient decided they could be helped by it if there were better ads for it than for something else or nothing?”

Surveys said the doctors-—not even the patients-—prescribed more of the drugs advertised in color in medical journals than the ones in black and white. Amazing.

We all know of the lavish cruise ships in the Mediterranean where doctors were feted if they prescribed more of a certain group of drugs. Supposedly no longer done, they say.

One more:
It used to be illegal for a lawyer or law firm to advertise.
That one takes us back if we’re a little older.

The story:
“turning point came in 1977 when the Supreme Court of the United States decided in Bates v. State Bar of Arizona that blanket prohibitions on lawyer advertising are inconsistent with the freedoms guaranteed under the First Amendment. This landmark ruling set the stage for lawyers to start advertising on TV and other media outlets.”

I’d bet Politico would be OK with RFK,jr. banning pharma ads if he was still with the Dem/totalitarian political party...

Pharma owns Fox News (and all the others). Why else do you think they fired Tucker, their #1 host by far, right after he had RFK Jr. on his show?

As I understand it, Pharma ads are banned in many countries. But they don’t have the 1st Amendment regarding free speech. Don’t know the details of how cigarette ads were banned. Was it part of the settlement of all the lawsuits?

“Ask your doctor of Qizxectic is right for you”. I’d like to hope that my doctor knows more about what’s ‘right for me’ than I do after watching some ad on TV.

May I ask why you are ideologically opposed?

I have reservations myself, but fall 60-40 in favor of removing the ads. I can explain my reasoning if you would like.

I actually think the adds are of great value, but you have to watch it all the way through. Why?, because that is where they list all the side effects. How else would I know 9 out of 10 say that the medication could cause heart failure, stroke, liver failure, renal disease, and a multitude of other potentially fatal illnesses. You know your Dr won’t tell you.

If they can ban cigarette commercials and others, they can ban drug company ads. They need to ban lawyer ads also. When did they become legal? In the 60’s, they could not advertise like they do now.

I don’t mind over the counter ones so much, but why have prescription ads? It makes no sense. You can’t just go out and buy them and they already push their pills with freebies and samples for doctors directly.

Well after the tv ban the tobacco companies invested and did magazine advertising. What is a magazine anymore

These drugs are not something that any person can buy without a prescription. I want them to go away unless I can go out to the drug store and buy them off the shelf.

They are not direct ads for the consumer.

Banning these ads needs to be done. If they can ban most booze and ciggies, they can ban these because they can be just as dangerous.

Considering that the “COVID vaccine” was one of the few ‘disaters’ that saved millions of lives.

But you bring up an interesting point, most drugs have pretty much the same side effects that the COVID vaccines have. Yet, too many get their panties in a wad over the COVID vaccines which saved millions of lives.

Anyone remember after the cigarette ban, you had the little cigars ads for awhile. They found a loophole that was eventually closed.

Cigarettes will kill about 1 in 10 users.

No prescription drug is anywhere near as deadly.
