the Supreme Court overruled themselves.

On the contrary, SCOTUS’ decision in Wong Kim Ark should uphold this measure. Had it not been for the 1882 Chinese Immigration Act, the Wong Court said Ark’s parents would have been permanent residents, and thus, Ark was a 14A ยง1, birthright citizen.

The Wong decision was a 6-2 decision with one Justice not voting, so it’s not a slam dunk decision. There is room for debate. Let it begin again.
