The Supreme Court will hear arguments Tuesday in a case that could reduce the scope of one of the nation’s bedrock environmental laws.
The case deals with the National Environmental Policy Act (NEPA), which mandates that the government consider the environmental impacts of its actions before moving ahead with them.

NO, I am ASSUMING the court will evaluate whether an unelected agency can mandate laws.

These are not bedrock laws. The Constitution is. These are anathema to the Constitution.
If Congress wants Project X, the Project should proceed.
Congressional representatives should have time to analyze bills.
Possible objections should be raised to Congress.
Gorsuch has recused himself.

The article was so biased, and poorly written as to be almost unreadable, Just what was the case about? An over reach of executive power via regulation? Hard to say.
Environmental laws are often 1) so vaguely written as to preclude any activity a bureaucrat doesn’t like and 2) a violation of the “Due Process” clause regarding taking of property.
Declare NEPA unconstitutional...and watch as we save $1 trillion overnight.
The EPA was created by Executive Order and should be ended by Executive Order

I thought the Supremes already ruled that that is a no-no.
Kind of torn about this since it involves Federal Actions. It does seem appropriate that for Federal projects and facilities some consideration for environmental impacts should be considered. We don’t need a bunch of Raritan Arsenals happening again where the government just dug holes and buried ammunition and mustard gas in the ground to get rid of it. Years later when the Arsenal was closed and private developers built on the property, all kinds of nasty and dangerous surprises cropped up.

That really sucks. This is a hugely important case we needed his vote. You can bet no rat would recuse themselves. In fact the only time a rat Judge will recuse themselves is if them not recusing guarantees an appeal being granted. I’m sick of our side fighting a one-armed fight.
