Regardless, once a Federal District Judge says “you can’t spend that money”, it’s not clear that the individual has the right to just shrug and continue on as if nothing happened. Nominally I would expect that the DoJ would have to step in and appeal it with an actual Federal District Attorney. Smith would have to step aside, even from the other cases.
But since Garfinkel recused DoJ from these cases and set up Smith as his potemkin Special Counsel, that itself becomes difficult. How is a partisan DoJ going to go about prosecuting the opposing party’s candidate?

The poster who said Trump’s team hasn’t brought up the dismissal. Well, possibly not in a formal response but the campaign is already saying it. Would expect to see it come up soon. It’s an issue that can’t be ignored, and Smith playing the edge (like always) isn’t going to help himself especially when it comes to the matter of him controlling government money when he has been adjudicated to be unqualified to do so. Treading on thin ice it would seem.
