TikTok is fighting back in its latest court filing in the battle over its future in the U.S., arguing that the law that could ban the app represents "the most sweeping speech restriction in the country's history."
The court filing on Thursday is the latest salvo in TikTok’s lawsuit seeking to block a law from taking effect that would shutter the app’s American operations unless it divests from ByteDance, its China-based parent company.
Oral arguments in the case are scheduled for Sept. 16 before a federal appeals court in Washington where lawyers for TikTok will ask the court to halt the law.
The Justice Department has defended the law President Biden signed in April on national security grounds. They have stated that the app could be weaponized by China to disseminate propaganda to 170 million Americans and that TikTok could be used to help the Chinese government collect personal information of its users.
Free speech protections, the government has argued in its papers, should not extend to a Chinese-controlled recommendation engine.
But in its new filing, TikTok’s legal team responded that the U.S. is illegally singling out TikTok and echoed what has become a common refrain from the company: The government’s fears are speculative and lack hard evidence.
“The government cites no evidence of this supposed Chinese control—and its contention is flatly wrong,” TikTok attorney Alex Berengaut wrote in the filing to the Court of Appeals for the District of Columbia Circuit.
The Justice Department’s legal papers defending the law include large sections that have been redacted, portions that could contain classified information about TikTok. And one crucial question is what exactly the government has learned about the app that it has not yet made public.

I don’t have tiktok installed on any devices but when I have gone to their website it seems like a bunch of cell phone videos taken in portrait mode made by idiots. It does not feel very threatening.

TikTok never reveals why a post gets removed or an account banned.
But they demand transparency from our intelligence agencies.

It’s a great app, beats anything Zuck has out and was kicking his ass. It hosts massive amounts of conservative content. So Zuck called up his paid for congressmen and demanded protection from a competitor with a better product. He told them he didn’t need to contribute if he doesn’t get protection in return.

The Supreme Court needs to get involved and prevent TikTok from getting banned. If they don't do that, FR will be next on the list.
Protecting America they say? The people who have deliberately flooded 20 million people, countless terrorists, tons of fentanyl, conducted mass release of violent prisoners, eliminated bail requirements, unleashed covid, BLM and antifa, unleashed the most massive domestic spying regimen in human history, killed the dollar as a reserve currency, forced perversion on our children, and weaponized every scrap of our data, etc etc etc…

I CANNOT understand why this is so hard for folks to grasp. But it’s for the kids! They are willing to give away the whole internet for the kids. The government could care less about our kids, this is all about complete and total government control of information.
That is how China’s censorship and complete internet control started... The excuses was “For the Children” and to install government forced morality.
The Squad and the Freedom Caucus voted against the TikTok ban (with few notable exceptions among members in the House).
The uniparty is working to have us silenced. The Republican Party is not our friend.
The greatest threat to American Democracy, in the minds of Democrats, is information.
When applied to an existing business on anti-trust or security grounds, the result of a forced divestiture is usually that the seller gets a big bundle of cash. A forced divestiture of TikTok under the law at issue would have the same result.
What TikTok really wants is for the Chinese communists to have a potential agent of espionage and influence installed on millions of American smart phones on First Amendment grounds. I think that is untenable as a legal argument. TikTok is likely to lose in the Supreme Court.

I am on telegram a lot people post MANY, MANY TikTok conservative videos there HUGE amount of the black community posting videos for Trump I don’t have a Tic Tok account but I really enjoy seeing these videos others are posting!! These TicTok videos are getting the word out there it is no wonder the Dems want to ban it, I believe TicTik is a HUGE reason why the black community is coming our way!!
I read the law, did you read the law? It gives sole discretion to the President to determine which platforms are considered foreign adversaries. He could claim Russia, Russia, Russia just because the FR supports Trump.
It is not rocket science. Once they open this door they will abuse it. They ALWAYS do.
They did find a way to control Twitter, before Elon bought it. They had FBI operatives embedded within it. Elon had to fire them all.
