I didn't say it was a tough legal call, I did say that it is a tough political call. Legally, you are correct. Comstock prohibits such shipments. Politically, Trump needs his pro-life base, but he also needs the "pro-abortion and otherwise conservative" soccer mom vote. Why? Because the amount of likely fraud will mean he needs to win big. In this case, large numbers of voters will be upset either way.

Hence, it is a tough political call.

Yes, he could have said, "They can use UPS, Fedex, or any other alternative, Comstock notwithstanding," or "We're still studying that," but he didn't. That was dumb.
