House Speaker Mike Johnson said Sunday he could foresee “legal hurdles” in some states if President Biden is replaced as the Democratic nominee.
He told CNN’s Jake Tapper on “State of the Union” that Democrats will have “real problems” if Mr. Biden is pushed to be replaced.
“I mean, every state has their own election system. That’s our constitutional system,” said Mr. Johnson, Louisiana Republican. “That’s the way it’s done. And in some of these states, it’s a real hurdle. They have a real problem of replacing the nominee on the top of the ticket.”

I’m probably late to this already, but I predict Dem-rats will level instant charges of racism against any State or official that dares follow its own laws and impede the Party wishes.
There are a few hardened individuals and more every day who can stand firm, but most elected types are terrified of an “ist” word and will run screaming into the hills and fold.
The remainder will encounter a deep leftist judge who just happens to pull the docket for the Dem-rat lawsuit.

Good question—things get wacky in senile world unless there is a clear power of attorney established before the subject goes off the deep end.

There is ZERO problem with the DNC delegates choosing to nominate someone else.
Zero.
Biden was not the nominee, because the delegates select the nominee, and then communicate their selection to the Secretary of State or Board of elections for each State.
They have not done that.
Therefore there is no nominee you, and all this nonsense about State Laws is just uninformed claptrap.
He is not correct. He’s completely wrong.
But Biden hasn’t been put forward as the Dem. Nominee. The convention determines that.
Only after the nominee’s name is submitted to the Sec. Of State can one start to consider what is required to replace them.
Agreed...I don’t think he’s on any state’s ballots, yet....and now....never to be.
There may be another issue, too, Johnson wants to challenge: Biden/Harris campaign funds.
The assumption was if Harris was on the ticket, she could use the 90M....but that may be challenged.
