Judge dismisses classified documents indictment against Donald Trump.
The federal judge overseeing the classified documents charges against former president Donald Trump has dismissed the indictment on the grounds that special counsel Jack Smith was improperly appointed, according to a new court filing Monday.
U.S. District Judge Aileen M. Cannon’s ruling is a remarkable win for Trump, whose lawyers have thrown longshot argument after longshot argument to dismiss the case. Other courts have rejected similar arguments to the one that he made in Florida about Smith’s unlawful appointment.

The judge needs to send the bill for Smith’s fishing expedition to Merrick Garland along with a seizure of all his assets until the bill is paid in full.

All of these cases against Trump were always going to go away. Their purpose was to wake the public up.

Just watched CNN on the matter. The news “reporter” immediately suggested that the Appeals Court remove this judge when they appeal the case. Not even a semblance of objectivity.

This case was selective prosecution anyway. No ex President has ever been prosecuted under the Espionage Act of 1917 even though they typically took National Defense Information and other Federal records with them when they left office (they were still declassifying some of Eisenhower’s paper just a few years ago). It is pretty obvious that the possession element of the Espionage Act never was intended to apply to ex President’s who retained their authorization to access National Defense Information even after they left office. The Presidential Records Act has no penalty provision so that is a dead end. You cannot have a criminal conspiracy without an underlying crime and if there is no Espionage Act violation there cannot be any conspiracy.
Jack Smith should lose his law license. He’s not practicing law, he’s just waging lawfare against his political opponents. Marchan, Braggs and Fani are a joke, and Merrick Garland is the worst AG in history.
