The problem that it is not only the democrats that could go to prison. There are plenty of Republican in the Senate that have a lot to hide. So they won’t vote for real law and justice AG.
It’s a good recipe for a stable, functioning government for the next 250 years! NOT! The Republic would promptly crumble if such legislation ever passed.
The issue of danger to the Republic was addressed in the Immunity decision.

The Republicans have only a 7-seat advantage in the House and the Democrats are hopeful of taking control (gerrymandering has possibly made some seats easier for them to capture).
So if they have the White House, Senate, and House next year, they can pass a Bill of Attainder condemning Trump for insurrection and have him imprisoned. Of course they may deem it necessary not to call it a Bill of Attainder, but with a Supreme Court majority it would pass muster.
Not that I think this scenario is a likely one.

Only the judiciary can make that decision whether the act was official. Schumer is an inexperienced lawyer talking out his butt. Merely declaring the duty as unofficial after the fact is not for the Senate to determine. Courts and juries make that decision based on the evidence
