They first need to obtain an enforceable criminal conviction. That happens when the judge enters the judgment of guilt. That will not happen before September 18, and likely never, in view of recent Scotus opinions.
In another case, Scotus forbade the introduction of evidence about the official conduct of the President. It would appear that Judge Merchan allowed introduction of such evidence over defense objection. There appears to be reversible error negating any verdict. The sentencing set for July 11 was delayed to September 18 to consider the apparent prosecutorial catastrophe.
