It’s all up to serious (/s) people in the Cabinet — such as Blinken, Granholm, Mayorkas and Buttigieg — to gang up and notify Congress that the president is incapable of performing his duties.
That’s if they do it by the book.
These are Democrats, so who knows.

If the cabinet senses that Biden will lose in November AND they are in danger of criminal prosecution without a pardon, they will axe Biden with the 25th Amendment. Removing Biden's powers this way makes it less likely Hunter, Jill, James and company will get presidential pardons after the election.
