You may be right, but a little birdie tells me this will be much broader than some narrow ruling on process. It wouldn’t meet the moment. In light of the blatant abuse of the legal system in pursuit of political ends, SCOTUS may now seize the opportunity to remove courts out of the political arena as much as possible.

The immunity decision will be out in the next couple of weeks. If it isn’t entirely to the liking of Rat Party Headquarters they will go absolutely ballistic!

No. They take a vote right after the case is heard and assignments are made.

Everything they do is in writing. The initial opinion is written and then those on the same side may not like the wording and may want to make a concurring opinion, but the main author may negotiate...everything is in writing - not to mention trying to get others to change their vote and join the other side.

There is a ton of back and forth and can take many months.

I knew a guy who was Rehnquist’s personal assistant, who kept track of the votes and everyone’s in/out basket and the status of each opinion and its progress.

He would occasionally tell me the day before when a major decision would be issued, but he never ever told me the vote on any case.

You’re welcome. I enjoy the intricacies of law and the opinions issued by the court. It’s always enjoyable to discuss the ins and outs of the rulings with others.

FYI, here is an article from Reason discussing the number of opinions issued by each Justice. Professor Adler’s numbers differ slightly from mine and has Roberts as issuing two opinions. Since my calculations were done quickly (literally on the back of a envelope), I’m sure his numbers are correct.

“Supreme Court OT2023 at the Middle of June”

https://reason.com/volokh/2024/06/14/supreme-court-ot2023-at-the-middle-of-june/

Professor Adler also notes the number of opinions issued by the liberal justices. As I said, we may not get anymore by Sotomayor since she has written 7 this term.

This paragraph is encouraging:

“Of the remaining cases, the lion’s share will be written by conservative justices. The liberal justices represent one-third of the Court, but have been responsible for 40 percent of the Court’s majority opinions thus far. I would not be surprised if liberal justices write no more than four or five of the remaining majorities.”

I know nothing about the law and find it very confusing, so I’m very happy to have found someone to follow that can tell me what it means. Do you have a ping list?

I’ll be thrilled if one of the conservative justices rights the majority opinion on presidential immunity. It’d be best if it was a real conservative, like Thomas or Alito.

I don’t have a ping list. But, just click on the SCOTUS keyword at the top of the home page and it will take you to the latest supreme court threads that I or anyone else has started. I always add SCOTUS as a keyword.

This morning, SCOTUS added a second Opinion day to the calendar for this week. We will get opinions on Thursday AND Friday. I’ve made a note on my calendar to start threads on both days (I’ll try to not confuse Thursday and Friday this week).

I’ll ping you as well.
