Yes, though like many laws the potential penalties in the absence of other activity or circumstances are too harsh. Yes, drug use might be a circumstance as would being a felon, I think discarding the revolver in a garbage can is worse but that's on Beau's widow, but imo it would require something like a crime committed with said gun to deserve the kind of penalties he theoretically faces. I guess we just leave that up to the judge.
