What did they (prosecution, judge, etc) do to allow guilty verdicts on something that had passed the statute of limitations?

The statute specifies that if it can be proven that the misdemeanor was done in furtherance of a felony, then the statute of limitations is not considered to be expired. The prosecution never specified what that felony was until closing arguments and even then they gave jurors an option of 3 to choose from.
