Costello stated in Congressional hearings last week that Cohen signed a document waiving attorney client privilege for a cooperation agreement with the special prosecutor. So Cohen has no privilege with Costello.

They can still try to rehab Cohen before they rest.
They are redirecting Cohen.
It’s routine for the defense to motion for dismissal on the grounds that the state has failed to meet its burden.
