If the “Hitler” salute is illegal, is the black power salute? If not, will we have a ministry of salutes to determine which salutes are acceptable and which aren’t, like the ministry of silly walks?

My undergrad degree is a BA in History, and my education basically spanned the 1970s and 80s. From an early age, whenever I was able to take an elective, I took extra history classes. I always had teachers (Jr High Sch up through college) who wanted to talk about Marxism. Some of them did not like Marxism and wanted to teach about it as a dangerous thing that was un-American. Most of them liked Marxism a lot and wanted to teach about it because it would lead us all to a glorious future.

But the point is that I was taught about Marxism. Repeatedly. Good stuff, bad stuff. I was no stranger the politics of communism.

Fascism? Whole different thing. Never taught by anyone. No electives on that topic. It was bad, OK? They killed Jews, alright? Evil people. And that’s it. We’re done. You don’t need to understand what it looked like, the economics, the social movement, the view of history, the specifics of their crazy racial ideas. The only thing to know was: It was bad.

Consequently, almost no one knows Fascism even when it’s staring them in the face and saying, “No joke.”

This probably falls under the “fighting words” exception to the First Amendment.

The Wisconsin statute:

947.01 Disorderly conduct.
(1) Whoever, in a public or private place, engages in violent, abusive, indecent, profane, boisterous, unreasonably loud or otherwise disorderly conduct under circumstances in which the conduct tends to cause or provoke a disturbance is guilty of a Class B misdemeanor.

(2) Unless other facts and circumstances that indicate a criminal or malicious intent on the part of the person apply, a person is not in violation of, and may not be charged with a violation of, this section for loading a firearm, or for carrying or going armed with a firearm or a knife, without regard to whether the firearm is loaded or the firearm or the knife is concealed or openly carried.

Which might justify someone slugging him, but not the police arresting him. If someone wants to be a Nazi, it’s a free country and he has the right to do it. If he throws a Nazi salute, that’s freedom of expression. He can be shunned by decent people,
