Judge Juan could not write a better Amicus Brief to the Supreme Court for Trump’s argument than this. It demonstrates exactly the kind of frivolous abuse that politicized lower courts could inflict on the Executive when they are corrupted like Merchan’s court is. I think that Trump’s attorneys should go ahead and file this order with the Supreme Court.
The timing could not be better. What's happening in New York City today is exactly what future Presidents should fear when making executive decisions in a divided government.
If there are no limits on what a corrupt city burough DA could do, like taking a federal charge he can't prosecute to revive a misdemeanor charge he can't prosecute, and then harass the leading opposition candidate to interfere with his election campaign, then there should be no limits on Presidential immunities to prevent it from happening again.
The Bragg case itself wouldn't be affected by Presidential immunity (Trump wasn't President when the payments were supposedly made), but the behaviors of the Attorneys General, District Attorneys, federal investigators, and trial judges generally need to be reined in when dealing with decisions that Presidents made while still in office.
