Arizona Supreme Court rules that a near-total abortion ban from 1864 is enforceable

PHOENIX — The Arizona Supreme Court ruled Tuesday that a 160-year-old near-total abortion ban still on the books in the state is enforceable, a bombshell decision that adds the state to the growing lists of places where abortion care is effectively banned.

The ruling allows an 1864 law in Arizona to stand that criminalized abortion by making it a felony punishable by two to five years in prison for anyone who performs or helps a woman obtain one.

The law — which was codified again in 1901, and once again in 1913, after Arizona became a state — included an exception to save the woman’s life.

That Civil War-era law — enacted a half-century before Arizona even gained statehood — was never repealed and an appellate court ruled last year that it could remain on the books as long as it was “harmonized” with the 2022 law, leading to substantial confusion in Arizona regarding exactly when during a pregnancy abortion was outlawed.

The rats push two issues to fire up their base and it has worked in several state elections:

Getting pot legalization on the ballot. That is designed to get the traditionlly liberal but apathetic youth vote out.

Making the election about abortion, under the guise of women's rights. That alone touches 50% of the voting population.

The GOP will now lose Arizona in November.

Arizona is Conservative more in the Ron Paul sense than in the right-to-life sense. Nor that I am not right-to-life, I am, but I see Arizona as more middle of the road Conservative than social conservative.

When someone says "care" in the context of abortion, they need to be immediately and repeatedly punched in their lying mouth until they understand that lying about this subject deserves getting punched in the mouth.

I'm getting an uneasy feeling that the RINO state supreme courts in battleground states are wanting to help Democrats in the November elections.

That was my first thought as well.

Good point. It's "stare decisis" if the left wants to maintain the status quo, but "antiquated" if the left wants it changed. At least that's that humble opinion of this non-biologist who's typing this.

Well, if we can believe public opinion polls , only 13% of people in this country want to ban abortion in all circumstances.

Heck even here on Free Republic. , we are divided on what to do about abortion in our political system.

When put to a vote of the people, I don’t know if there’s any state in America where the people would vote to ban abortion completely.

Weird how Trump came out with his abortion speech yesterday and the Arizona Supreme Court ruled on 123 year old law today. If that is not collusion with the rats I don’t know what is. It seems like a well orchestrated and planned action to bring out the women’s vote. Suffrages should’ve never gotten the vote never. Sorry that’s the way I feel and I’m a woman.

So let me get this straight. Republican state supreme courts are ruling in favor of a Republican issue and that makes them RINOs?

Maybe this is bad politics, but calling it RINO is leftist levels of insane. FR has gone so far off the deep end now that a conservative ruling is RINO if it hurts Trump's chances.

Republican politics has been so hijacked by Trump that there is no principal except his electoral success. If Trump came out as pro-choice half the people who support him would instantly change their self-identification to pro-choice and half of the rest would somehow try to explain it as Trump really being more pro-life than anyone else.

There really isn't even the fig leaf of principal anymore. It is just group A and group B. The "left" who are winning the culture and have the most economic power yet think they are systematically oppressed, versus the "right" who are losing the culture and who are economically losing and think they are being ideologically repressed.

Just bizarre times all around.

Yep! There is zero chance of repeal, but please keep on making snide allusions to the folly of allowing females the vote. That should certainly help our cause. No chance that married women (who have long voted equally as conservative as their husband’s come election day) might become exhausted by or feel insulted by men in her own coalition casting equal aspersions on every woman for the idiotic & predictable voting patterns of a specific group of women: younger, unmarried, childless, faithless, indoctrinated, well-heeled, post-graduate, sheltered, urban & suburban women with no actual life experience & are existing in a bubble. No chance that constantly listening to a group of men in her own coalitionmight become so tiresome that she throws her hands up & opts not to vote because she senses she isn’t welcome anymore.

I can honestly tell you that I consider myself an extrist right-wing conservative that sits somewhere to the right of Ghengis Kahn: I’m a morally traditionalist, economically free-marketeer, Constitutionally originalist, small government libertarian who believes in a complete immigration moratorium, uniculturalism, heavily guarded borders, total opposition to international organizations or trade alliance& the enactment of every election, law practice, ID & and oversight, quadruple-checking procedure that makes vote fraud impossible for leftists.

Sick of the bull crap of some of yall! Not sure how it isn’t remotely obvious to you. The whole goal of an election is adding votes to your cause & your candidates. Whether anyone likes it or not- winning now & for the foreseeable future depends on winning over the votes of enough females & enough younger people & enough racially diverse folks to declare a majority victory on election day. My apologies to the millions of great American like you. To a small degree l know how you feel. I’m in Mi and people say it is bunch of clueless rats up here but not all if us not by a long shot. That said it’s just a fact without the women the rats would not control one part of the Government. With they have control of all of it. I hate saying it but it’s true.
