8th Amendment violation - take it to Federal court?

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Absolutely deprivation under color of law.

But the case is currently under the jurisdiction of the State of New York which hostile and unfair to Trump.

What James and the corrupt state of NY has done to him is completely unconstitutional but Trump has no case for Federal appeal until he has suffered harm

My bet is he is waiting for James to wrongfully seize his assets so he can circumvent the State of NY and go directly to federal court and appeal on constitutional grounds

If he posts a bond, he remains stuck in the insanely corrupt and biased NY “ justice “ system

My bet is James seizes Trump assets and Trump files for a stay in Federal court pending a federal appeal on constitutional grounds
