Samual Alito is supposed to be leading the 5th US Court of Appeals.
Well he is the circuit justice for the 3rs ans 5th Circuits. That means he decides on stays on cases coming from these courts. In this case, Alito stayed the first three judge panel's decision, meaning thought a majority of the court would decide that way, or possibly that he wanted to stay that decision. Alito is a federalist first, and a conservative second. It's a problem.
