I am not arguing that its ludicrous... Which is why it seems like a federal filing for violation of 8th ammendment should be automatic...

I just don’t know why it hasn’t been done, independent of this case.. The bond is needed for an appeal of this verdict of this case, it isn’t needed to launch a case claiming 8th ammendment violations with the fed.

Unless a case must run its course in the state courts before a federal court will hear it, which may be how it all works, I don’t understand how his lawyers haven’t already filed a federal case claiming 8th amendment violations

I’m not a layer, so I’m (at least) as in the dark as you. I’m guessing the case has to run its course in the state courts before appealing to the federal courts. At this point, Trump’s lawyers are still trying to appeal to the state, but don’t have the money to file an appeal.

By demanding $500M, NY is not only imposing an excessive fine, but essentially denying Trump his right to due process. You would think that would be enough to get an injunction, either in state or federal court. Maybe that happens when NY files to seize a Trump property.
