So define “embellish.” Who decides? What is the objective standard? The answer is that there is no objective standard. It is highly subjective and a Judge will decide. It’s New York State, so that will likely be a very very leftwing Judge.
Let’s say you own rental properties in an LLC. Ok, you go to refinance those properties. Or, you want to buy more properties and you list them as assets. The loan application asks you to assign a value. You do. It is irrelevant that the bank does its own underwriting.
Years later, you are at a school board meeting objecting to the porn they want to teach your kids. Well, look here. You are already labelled by the feds as a terrorist. Now, they can have NYS look into your business and go after you for having embellished your assets on your loan application.
Your defenses will be meaningless. Bring in an appraiser to say your are correct. The Judge won’t care. He won’t, especially a liberal judge. You are a white supremacist terrorizing school board meetings. Everyone knows those people lie and need to be punished.
