Folks, we need to be precise here. The 25th Amendment has absolutely NO provision for “removing” a President from office. Only impeachment and conviction can do that. All the 25th Amendment can do is to transfer the powers and duties of the President to the Vice President, who will be Acting President. Biden would still be President, and all he would have to do to regain the powers and duties of his office would be to send a letter to Congress asserting that he is, in fact, able to exercise them.

Thereafter, if the cabinet still wants to press the issue, they can do it again, and Congress then decides.

But in no case would he cease to be President before the end of his term unless he resigns, dies, or is impeached and convicted.

Details matter. We have to speak clearly and accurately about this.

And the Vice President invokes the 25th amendment against the President, not the Attorney General.
