I did my BCT in late 1969...not long after My Lai was news.One of the many classes we attended was one on unlawful orders. A 1LT conducted the class and basically informed us that we were not obliged to obey unlawful orders. The problem is that he never gave us a single example of such an order.

I wonder what would happen if Guard members refused to follow orders in this case...claiming they were unlawful.

You have an interesting point. In a prefect world a soldier refusing an unlawful order would not be punished. Unfortunately we a living in lawless times where justice does not always follow the rule of law.

To answer your question, considering today’s political climate, they would get a court martial. I’d say a firing squad would not be ruled out.
