And when the jury determines an award, they average out what each juror wants to give. Eleven jurors might all pick amounts in the $10,000 to $20,000 range, and the twelth might say, $500 million. So the verdict will be for over $41 million.
When I served as foreman on a civil jury assigned to award damages, we received no instruction about how to calculate an amount. So, in deliberations I proposed that method and the other jurors agreed. But we were not told it had to be done that way.
