Congress has to power to raise armies, and to keep them on federal property and territory.

Congress has the power to “make rules concerning captures on land and water”.

“Congress shall have power to...establish a uniform rule of naturalization.”

Last time I checked, the executive branch wasn’t Congress. It’s called the “executive” because its authority is to execute the laws that Congress passes. Also last time I checked, choosing to NOT execute those laws, and in fact to overtly break them, most certainly doesn’t entitle the executive to federal preemption over sovereign states that are desperately trying to defend their citizens FROM the result of the executives’ extra-legal actions.

Biden’s despotic actions to actually interfere with duly-enacted border laws places him and his “administration” outside their constitutional authority, and thus should entitle their evil efforts to NO protection via federal preemption. He and his minions are acting as criminals, not as legitimate representatives of the people.

Abbot MUST stick to his guns, no matter what the corrupt, tyrannical federal government attempts to do. If the feds take even the slightest step to try to impose their will on Texas by force, then not only SHOULD this become the flashpoint for a civil war, but it MUST become exactly that. Biden’s puppet masters can try to appeal to “preemption” and use a few morally-confused “justices” to endorse it all they want, but they are ALL operating WAY outside the intent of this nation’s founders, and should be ignored. If they don’t like being ignored and decide to use force to press their despotism, then far more than just Texas should rise to slap them down hard via any means necessary. It should be no surprise that we are at this sorry point; it has been coming for a long time, and I don’t see any peaceful resolution possible.

Does anyone really believe that the anti-American globalist tyrants, in either party, will EVER stop their assault on this country just because of some well-reasoned argument, or even because of legitimate attempts to tie their hands with laws? They don’t even obey the multitude of laws we already have, and the reason they so casually disregard them is because they don’t FEAR the people, as represented through their sovereign states. Today’s thoroughly corrupted caricature of a federal government needs to be taught their actual constitutional role, its significant limitations, and especially who their boss is, namely the States. We are not their subjects! They do OUR bidding, not the other way around, and Texas can take a big step toward reminding them of it.

That is a well-reasoned and sad post. Every American should greatly fear this possibility, but at some point the tyrannical government simply refuses to back down and respect the will of the people. The founding fathers also feared this possibility and yet provided guidance.

Unfortunately, the federal courts said otherwise when Obama sued Arizona over their SB 1070 bill.

The court basically said that federal prosecutors had "prosecutorial discretion" over where to spend their efforts (e.g., which illegals to prosecute and/or deport), and any state law infringes on the federal agencies' authority to exercise discretion.

In other words, the court said that if a state like Arizona kept arresting illegal aliens on their own and then turning them over to Border Patrol or Homeland/Immigration, that forces those agencies to have to deal with the illegals which takes time and budget away from other priorities that they had the power to set.

Letting states arrest illegals forces priorities onto the federal government, which the courts overturned.

It's like the states are the serfs for the federal government and not the other way around, which is what the 9th and 10th amendments were supposed to be for.
