I fail to see how ordering the murder of anyone can be an "official act."

If I were Jack Smith, I would suggest that he could do it by labeling them domestic terrorists, and of course you know we can defend ourselves against domestic terrorists. It is the same rationale they are using to try to destroy Trump.
