I don’t get excited about anything that seems to sound like a positive for Trump.
If there’s one thing we should have learned by now, it’s that that every institution in this country can come up with a reason to deny Trump justice for whatever reason or no reason at all: no standing, didn’t file argument in time, no merit, he has orange skin, whatever.
A pro-Trump argument? Baseless. Anti-Trump, no matter how preposterous? Bring it on.

If Biden were to appoint, the Senate would have to confirm. No chance of that. That’s why Smith wasn’t properly appointed in the first place.
Mark Levin served as Ed Meese’s chief of staff. Meese was Ronald Regan’s Attorney General. That was a time when we had an administration that was following the Constitution.
