Yes.....he is 92 years old.
P
Devil’s Advocate for a moment:
If the claim is based on fraud because Trump knew there was no fraud in the vote, then his defense would be to introduce the evidence of fraud in the vote upon which he made is representations. Other cases (there are many) have dismissed the claims of fraud based on a lack of standing for the accuser. Trump has standing to assert it as part of his defense.
If the case is thrown out because Smith had no authority, then the evidence of the fraudulent election will never see the light of day through its introduction as evidence in Trump’s trial. The merits will never be reached.
The public will continue to deny fraud in the election.
Is Meese providing cover for the deep state to give them an out so that the real truth of the fraud will never be seen?
Just wondering.

That says it all!
Not likely. Trump is trying to delay convictions in kangaroo courts before November.
"Who the hell woke 92-year-old Ed Meese up?Where was he and these Schaerr Jaffe co-filers when they were needed during Mueller?
The Amicus is (now proven) rock-solid, which makes their absence during TrumpI even more pernicious.
Schaerr Jaffe is a boutique white-shoe K Street firm that boasts former Trump OMB counsel Paoletta, and Eugene Volokh as an "academic affiliate" whatever that is lofl.
Oh but wait, Gene Schaerr signed off on this. Smart guy -- a former Scalia clerk and BushI Associate Counsel to the President.
So this is all about the Bushes preserving Poppy's vision of the Unitary Executive, not about helping Trump."
What "public"?
Regardless, even if The Bidet now appoints him, with Senate concurrence, everything he did while not an official is null and void IMO. That would really toss Jack the ripper into a box, perhaps one of criminal or civil behavior.
Durham was already a US Attorney, Jackoff Smith was a Private Citizen and required Senate Approval to be appointed.
No, this one is the DC appeals court.
Meese ALSO filed an amicus about the same issue at the Supreme Court, but this order (that both sides present arguments January 9) is from the U.S. Court of Appeals for the District of Columbia Circuit.
Yet light years ahead of Sleepy Joe in the brain power department.
Then again, my neighbor's dog is ahead of Joe.
Good catch...I should have said the legacy media...
>So then Biden will just appoint Smith (and then it’s legal).
He can’t. Congress has to. Just like Mueller.
