Under the 14th Amendment’s Naturalization Clause and the Supreme Court case of United States v. Wong Kim Ark, 169 US. 649, anyone born on U.S. soil and subject to its jurisdiction is a natural born citizen, regardless of parental citizenship. This type of citizenship is referred to as birthright citizenship.
Wong was never affirmed an Article 2 Section 1 natural born Citizen.
FOS. There is a “natural born citizen” clause in the constitution for a reason regarding the presidency. Wong addressed citizenship, not the question of natural born citizen.
There is nothing in United States v. Wong Kim Ark, 169 US. 649 that says Ark was an Art. II, §1, cl. 5 natural-born citizen. Let’s not forget, that Ark’s parents eventually moved back to China. Ark is a naturalized citizen at birth via 14A §1. Citizenship ascribed by law is naturalized citizenship. Citizenship ascribed by natural law as a natural right is natural citizenship at birth.
