I’m no lawyer but to be guilty of incitement you have to be very explicit in your language... “the culmination of a series of comments” isn’t the standard afaik. Trump said “we will walk to the Capitol and peacefully protest”. That’s not incitement. So they concoct this new theory about a “culmination”.
And yes I know this new filing doesn’t sound like a claim of incitement but still, the standards must be pretty close. I don’t know if there is any precedent for “a culmination of speech/actions” that holds a person culpable. Trump believed the election was unfairly handled and so did a lot of Americans. They all have the right to believe that and to say so.

Exactly. But, seems our rights to free speech and thought are under attack. When did it become a crime, in America, to voice a difference of opinion or disagree with elected Officials......even if shouted from a rooftop or on a billboard?
And, is it now a crime to advertise and offer a home or business for sale for an amount greater than what it was bought for?
