The constitution does not give states the right to interfere it’s navigable rivers, that is purely in the purview of the federal government.. it’s spelled out in the constitution .

Texas is in complete violation of the constitution with this nonsense.

They will, states cannot interfere with navigable rivers… constitution is very clear. The barriers are in violation of the constitution as well as the treaty of gualdlupe etc.

Texas does not have a legal or constitutional leg to stand on.

They will lose.

All the way to the US supreme court…. Lets do this. I am so sick of immigrants getting the one up on me. Texas has a right to protect its citizens not criminals.

Do the barriers stay while it is appealed?

For gods sake, just once defy them and say no. Then at least they will have to send Feds to do it and they will get what they call “bad optics”. Abbott will cave as he always does.

Article 1, Section 10, Clause 3 of the U.S. Constitution states, “No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.”

Given the current USSC majority, I think Abbott stands on pretty solid ground. That Texas and other states WERE INVADED is not even open to intelligent discussion.

The Rio Grande a navigable waterway? It is only navigable to swimmers, kayaks, canoes and small boats. Plus Abbott’s floating barrier does not impede such craft navigating the river on the US side of the border. It only impedes illegal traffic across the border.

Perhaps, they will lose. But if the Government refuses to discharge its responsibility to protect the state, does the state have the right to protect itself. That is the BIG ONE that the Supreme Court will have to decide.

Texas needs to erect stuff on Texas State land...
Even that will go through the courts, but it might have a shot

Immigration and naturalization are powers granted to the feds by that pesky constitution thingy..
The states have no right to interfere with the feds on their constitutional rights...

The Texas side of the Rio Grande is Texas soil. If the barrier crosses over into Mexico, then the Mexican government is free to dismantle it as they please. I am unaware of any international seaport on the US side of the Rio Grande.

That’s navigable. And the Rio Grande can and is used for foreign commerce (illegal commerce is still commerce!), which is specifically covered in the federal law on this. What Texas did violates international treaty law w Mexico, federal law on waterway obstruction and the constitution. Very dumb fight from Abbott from a legal perspective.
