Yes, it is, although it isn’t legal under Federal law. No problem for the lawyer, but maybe big trouble for Biden’s “child”. He is in the process of a plea-deal on Federal charges. Can Hunter pass a drug test? Who would dare to administer it, knowing that “No one f**ks with a Biden” according to the chief law-enforcement officer in the Federal government.

I’ll bet not associating with known drug users is a condition of his federal probation, and weed is still federally prohibited. Shame the Democrats never got around to de-scheduling it when they had the chance….

My understanding of probation is that prior to the acceptance of the plea deal the probation department must doing a document for the court showing that the defendant is likely to follow the rules of the probation agreement. In cases where drugs are part of the plea deal, (and I believe it is required in all probation cases), that the defendant pass a drug test and is subject to unannounced drug testing during the duration of the probation.
