Well unfortunately for Trump....the manner in which the corrupt FBI obtained the documents via their raid on Mar-a-Lago enables them to now say certain documents ‘were’ in Trump’s possession at the time. We suspected that they would either plant documents or lie about what was in the boxes at the time...and lo and behold, here we are with this latest “get Trump set-up”. The Marxist goons are nothing if not consistently predictable in their tactics.

The statute they used was part of what was originally called the Espionage Act, but the section they charged him under does not mention espionage, nor is it mentioned in the indictment.

I’m sure there are ways to challenge the indictment on many fronts, but arguing that Trump could have declassified the documents is irrelevant, and even if the tape is thrown out entirely, it wouldn’t result in the charges being thrown out on that basis alone.

I don’t believe the government and media. This recording speaks for itself. It is troubling as it suggests Trump is or has lied, else he is very cavelier about classified government documents.

I just listened to the recording again on Fox, and it hit me that Donald Trump was doing what he does best: trolling and mocking. The sarcasm was palpable. I’m more convinced now than ever before that there is no there there. Now it’s time to get to the bottom of the leaks from the DOJ to their media accomplices. Nothing but crickets so far.

It is directly and explicitly stated at the top of page 26. It is part of the Espionage Act. Here is the table of contents of the entire code. You will see section 793 is included in the table of contents.

If it seems confusing that the espionage act is being used to charge Trump when section 793 doesn’t mention anything about espionage, then you may want to investigate the other times it has been used to charge people. It is a shit law and overly broad.

President Wilson, who signed the Espionage Act into law, used it to persecute over 2,000 Americans during WWI. The USSC upheld most of those convictions under the pretense that it was used at a time of war. (Funny, I never read or found the ‘except at time of war’ clause in the U.S. Constitution. It must be close to the time of pandemic clause, but I haven’t been able to locate that either.)

Slowly cases have come forth that whittled away parts of the act and all of the Sedition Act, which Wilson signed into law. That doesn’t mean that what remains of the Espionage Act is still good law or even constitutional. It means it hasn’t been tested. (You may get the idea that I don’t like Wilson at all. He used to be my most disliked President prior to Obama and then Biden coming along. He’s now number three. You don’t want to know who my number four is.)

Understand this one thing: the Espionage Act was originally used by Wilson against political enemies and it is being used by Biden against his political enemy.

Compare the true intent of government in this case against Trump’s intent. It is an injustice.

That section of the law was part of the Espionage Act, but espionage is not mentioned in the indictment. I know the history of the Espionage Act and agree with you about how it has been used. Trump may be able to get the section declared as unconstitutional, but generally that would require a conviction and appeal. And as I said, the charge is not espionage, it is willful retention of national defense information. This is the specific subsection he is charged under :

(e) Whoever having unauthorized possession of, access to, or control over any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted, or attempts to communicate, deliver, transmit or cause to be communicated, delivered, or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it to the officer or employee of the United States entitled to receive it;

The bolded sections are the elements the prosecution would have to prove; that Trump was unauthorized to have the information, that it was national defense information which could harm the US or aid a foreign nation, and that he willfully retained the information.

Correct. I think we both have been on the same page about that, at least now we are. I’ve always been referring to section 793 (e).

It is now clear that Smith leaked to obfuscate the damning evidence that emerged yesterday on the Biden payoffs. As I said, Smith did not have evidence. He had only hearsay that wouldn’t work, so he leaked it.

Just think how we’d be able to go on offense against Biden if we weren’t always stuck on defense with Trump. His excuse for keeping this crap is “it was mixed in with old shoes and golf shirts and I never had time to look.” Too busy playing golf, obviously.

They don’t have to prove he intended to injure the United States. What they have to prove is that he knew the information could be used to injure the United States or to aid a foreign country. I suppose Trump could argue that he didn’t realize that information on our military capacity, nuclear capacity of foreign countries, US nuclear weapons, etc., was information that could injure the US or aid a foreign country, but if true, is that sort of ignorance really something we want in a president? I think the better defense might be to argue that he didn’t know he had the material since he hadn’t finished reviewing the contents of the boxes, but I don’t know if that would work either, since his attorneys certified on his behalf that all of the boxes had been searched and all material with classification markings returned prior to the raid.
