That’s the general consensus based upon the questioning by the justices during oral argument. However, Roberts is the wild card. The Chief Justice can explain why a law, policy, or regulation is unconstitutional and then rule in it’s favor regardless of his own finding. He tends to favor the bureaucracy if there is a constitutional question regarding their right to implement a policy before the Court.
