No word about Neely's drug levels? If it was fentanyl and Neely had a bad heart, he would be extremely vulnerable to death as a result of respiratory depression. Death from a chokehold would be magnified by the fentanyl. Actually all one had to do is tackle Neely and knock the wind out of him and that would have triggered heart failure.
An example of respiratory depression is commotio cordis (the wind knocked out of one). An athlete gets hit in the chest with the ball and collapses, suffering sudden cardiac arrest. Without immediate care, the athlete will die. Instead of being a Marine, Daniel Penny could have been a football player. What would have happened if Penny tackled poor Neely?
Does one have to do a medical test for fentanyl to defend oneself and others? Are the public so stupid they have no clue about the effects of these opioids on respiration and exactly why such drugs kill?

the defense will use the death threats as defense. The prosecution will likely mention the absence of a weapon and the argument that the marine could have let go of the victim’s neck earlier.

Neely never laid a hand on anyone on that train.
He made verbal threats. He was causing a scene. He was in an extremely excitable mood.
Sure Neely has a history of violence but Penny didn’t know about that.
All Penny saw and heard were verbal threats.
If Penny only grabbed Neely by the arm, that would be an assault. Penny wasn’t defending anyone from harm. Penny was restraining a man causing a disturbance.
If you are driving to Church and accidentally hit a bicycle rider because you failed to see them, and the died as a result……..you committed Manslaughter.

I have always been against chokeholds. Chokeholds have become popular from WWF wrestling or WEF wrestling. Fake wrestling shows.
Chokeholds are dangerous and even Detroit Police won’t use them.
One can never gauge how much of a chokehold is too much, and then does the person that was choked out need CPR?
Bragg should have had a Grand Jury decide on what if any charges should be made.

These kinds of incidents become more prevalent, when the city police force is discouraged from dealing with vagrants and petty crimes like loitering, disturbing the peace, etc. Citizens are forced to deal with it themselves. Giuliani had instituted a policy of dealing strongly with these kinds of crimes, and the effect was a significant drop in violent crime.
An additional outrageous thing about this fat DA is that there were at least two other people restraining this animal, one was black. Why is the black guy who helped the former marine not being charged as an aider and abetter or as a co-accused to this hit job? The answer is because it is a racist hit job on the white guy.
